By accessing or using BufferMind ("the Service"), provided by ZCC Labs LLC ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. These Terms contain an arbitration agreement and class action waiver (Section 22) that affect your legal rights.
BufferMind is a real-time AI-powered platform that provides live transcription, translation, and intelligent note-taking for lectures, meetings, and conversations. The Service also includes an AI assistant ("Andy") that answers questions about your recordings, photos, and course materials; a two-way Live Conversation (interpreter) mode; Voice Typing on macOS; organization of recordings into folders; and social features that let you add friends, exchange messages, photos, videos, voice messages, recordings, and folders, and make one-to-one voice and video calls. The Service is available via web browser, a macOS application downloaded from our website, and an iOS application from the App Store. Features vary by platform, and we may add, change, or remove features at any time.
You must be at least 13 years of age to use the Service. If you are under the age of majority in your jurisdiction (18 in most U.S. states, higher in some countries), you may only use the Service with the involvement and consent of a parent or legal guardian. In the European Economic Area and the United Kingdom, users must be at least 16 unless applicable national law permits a lower age. By using the Service, you represent and warrant that you meet these requirements.
You may use BufferMind as a guest or create an account. Guests have shorter recording limits and cannot use friends, messaging, calls, or sharing. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must not share your account with others or allow unauthorized access. Notify us promptly at support@buffermind.com if you suspect any unauthorized use of your account. You may maintain only one account per person unless we agree otherwise.
Usernames. To use social features you choose a username ("BufferMind ID") that other users can see and use to find you. Your username must not impersonate another person, organization, or brand; must not be offensive, misleading, or infringe anyone's rights; and must follow the format rules shown in the app. Usernames may be changed only occasionally (currently once every 30 days). After an account is deleted, its username is reserved for 90 days and then released. We may reclaim or change a username that violates these Terms, that has been inactive, or that is needed to resolve a legitimate dispute.
BufferMind team account. When you create a username, the BufferMind developer account is added to your friends list and sends you a welcome message so you can reach us directly with questions or problems. You may remove it at any time; we will not add it back.

Recording laws vary significantly by jurisdiction. Several U.S. states — including California, Illinois, Florida, Maryland, Massachusetts, Pennsylvania, Washington, Connecticut, Michigan, Montana, Nevada, and New Hampshire — are "two-party" or "all-party consent" jurisdictions, requiring the consent of every participant in a conversation before it may be recorded. Many other countries have comparable rules, including the People's Republic of China (under the Personal Information Protection Law), the European Economic Area (under the General Data Protection Regulation), the United Kingdom, Canada, Japan, and others.
These rules apply to every feature that captures other people's speech, including recording, transcribing audio playing on your computer, Live Conversation mode, and live captions during a call, which send the other participant's speech to our speech-recognition provider for transcription. By using the Service to record or transcribe, you represent and warrant that:
ZCC Labs LLC does not condone unauthorized recording and disclaims all liability for violations of recording consent laws by users of the Service.
Social features are strictly one-to-one and only work between two users who have each accepted a friend request. There is no public feed and no way to message a user who is not your friend.
The Service, including all software, design, branding, graphics, and content, is owned by ZCC Labs LLC and is protected by copyright, trademark, and other intellectual property laws. All rights are reserved. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features.
BufferMind™ is a trademark of ZCC Labs LLC. All other trademarks referenced in the Service are the property of their respective owners.
You retain ownership of the recordings, transcripts, messages, photos, videos, notes, and other content you create, upload, or send using the Service ("Your Content"). By using the Service, you grant ZCC Labs LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, and display Your Content solely to provide the Service's features to you and to the people you choose to share with — including transcription, translation, AI analysis, playback, cross-device sync, backup, delivering messages and calls to your friends, creating a copy of a recording in a friend's account when they import it, and displaying content through share links you create. This license ends when you delete the content or your account, except for copies that others have received or imported as described in Sections 7 and 8, and backup copies that are removed in the ordinary course. We do not use Your Content to train AI models or for any purpose beyond providing the Service to you, except that we may use aggregated, de-identified statistics (e.g., total hours transcribed) for service improvement and capacity planning.
You are solely responsible for Your Content, including its lawfulness and its compliance with any third-party rights (copyright, privacy, confidentiality, professional duties, etc.). If you send us feedback or suggestions, we may use them without obligation to you.
Certain features of the Service (such as speaker diarization, which separates multiple speakers within a session) may cause our transcription provider, Soniox, Inc., to generate transient voiceprints from audio you submit to the Service. These voiceprints are used only for within-session speaker separation and are processed transiently by Soniox. ZCC Labs LLC does not store voiceprints, does not use voiceprints for identification or authentication, and does not associate voiceprints with real-world identities.
Retention and destruction. Transient voiceprints are discarded at the end of each transcription session per Soniox's processor terms. ZCC Labs LLC retains no voiceprint data at rest. The transcribed text and any saved audio recordings are retained as described in our Privacy Policy.
Your consent and opt-out. By enabling speaker diarization, you expressly consent to the transient processing of voiceprints as described. You may opt out at any time by disabling speaker identification in the Service's settings; the Service will function without speaker labels. If you reside in Illinois or another jurisdiction with specific biometric-information laws (such as the Illinois Biometric Information Privacy Act), this Section, together with the Privacy Policy, serves as our written notice and record of your written consent to such processing.
Transcripts, translations, summaries, titles, answers, and Andy's responses are generated by automated systems, including third-party AI models, from the audio, text, and photos you provide. AI output may be inaccurate, incomplete, biased, offensive, or fabricated, may not reflect the actual content of the source, and is provided for your convenience only. You are responsible for reviewing AI output before relying on or sharing it. Andy may offer guidance while you are on a phone call (for example, explaining an automated phone menu); that guidance is informational and you remain responsible for what you say and do. Do not rely on the Service for medical, legal, financial, safety-of-life, or other high-stakes decisions. Subject to the rights of others and applicable law, you may use the AI output generated from Your Content as you see fit.
BufferMind offers a free plan and paid plans. Each plan includes a usage allowance that is measured by the cost to us of the features you use — transcription minutes, AI questions, summaries, course analysis, and call relay data all draw from the same allowance. The app shows this allowance as approximate hours; the actual number of hours you get depends on how much you use AI features and other services. Allowances reset each calendar month (or other period stated for your plan) and unused allowance does not carry over. We reserve the right to modify usage limits, features, or pricing at any time, and will provide advance notice of material changes affecting existing users.
When an allowance runs out. If your allowance is exhausted while you are recording, the app gives you a short grace period (currently five minutes, extended while you are completing an upgrade) and then stops and saves the recording. Starting a new recording or using AI features requires upgrading or waiting for your allowance to reset. Guest sessions have a fixed per-recording time limit regardless of allowance.
Promotional credits. We may offer complimentary plans or allowances, such as a one-month plan for you and a friend when you first add each other or when a friend signs up with your referral link, or a bonus for sending feedback. Unless the offer states otherwise: promotional credits are available once per person for the lifetime of that person, regardless of how many accounts they create (we keep a privacy-preserving record derived from your email address for this purpose, including after account deletion); are non-transferable and have no cash value; do not stack, though a reward earned while you are on a paid plan may be applied after your current paid period; may be subject to daily or monthly caps; and may be modified, paused, or withdrawn at any time. We may revoke credits obtained through self-referral, fake or duplicate accounts, or any other abuse, and may suspend or terminate the accounts involved.
Abuse of the free tier (for example, creating multiple accounts to circumvent limits) may result in account suspension or termination.
BufferMind offers optional paid subscription plans (currently "Pro" and "Max") that unlock higher usage allowances. Current plans and prices are shown on our pricing page and at checkout; prices may vary by country, currency, and storefront, and may exclude applicable taxes. A subscription applies to your account on every platform, regardless of where you bought it, and you may hold only one active subscription at a time. Subscriptions are managed where they were purchased.
Purchases made on buffermind.com, including from the iOS app in the United States storefront through an external link, are processed by our payment provider, Stripe; we do not store your full payment card details.
Subscriptions purchased inside the iOS app through Apple's in-app purchase system are billed to your Apple account and are governed by Apple's Media Services Terms and the standard licensed-application end-user license agreement, in addition to these Terms. Apple manages renewal, cancellation, and refunds for those purchases: cancel in your Apple account's Subscriptions settings at least 24 hours before the end of the current period, and request refunds from Apple. We are unable to issue refunds for App Store purchases. Apple's billing periods are not aligned to the calendar month. By purchasing through Apple you agree that, if Apple asks us to help evaluate a refund request, we may share with Apple the limited information it requests, such as whether the subscription was delivered and used.
Outside the United States storefront, the iOS app offers purchases only through Apple. In the United States storefront you may choose between Apple in-app purchase and our website; each purchase is governed by the terms of the channel you choose. The macOS app does not sell subscriptions; purchase on our website and your plan will apply on macOS.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the BufferMind applications on devices you own or control, solely to use the Service. The macOS application is distributed directly by us, is not sandboxed, and checks for updates only when you ask it to; you agree to install updates we make available in order to keep the Service working and secure. Features may require operating-system permissions — microphone, camera, notifications, local network, and on macOS Screen & System Audio Recording (to transcribe audio from other apps) and Accessibility (for Voice Typing) — which are described in our Privacy Policy; declining a permission disables the corresponding feature. We may offer features labelled beta or preview that may change or be withdrawn without notice.
We have no tolerance for objectionable content or abusive users. Although we do not pre-screen private messages and have no obligation to monitor content, we may review content that is reported to us or that we otherwise become aware of, and we may remove or disable access to content, restrict features, and suspend or terminate accounts that violate these Terms, without notice and at our sole discretion.
To report a message, press and hold it in the conversation and choose Report, or email support@buffermind.com with the username and a description of the problem. We review every report and aim to act on reports of objectionable content within 24 hours. To stop someone from contacting you, remove them as a friend; they will no longer be able to message or call you. We may cooperate with law enforcement and disclose information as described in our Privacy Policy.
We respect intellectual property rights. If you believe content available through the Service infringes your copyright, send a notice to support@buffermind.com that includes: your contact information; a description of the copyrighted work; the location of the allegedly infringing content (for example a share link or username); a statement that you have a good faith belief the use is not authorized; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will remove or disable access to content in response to valid notices and may terminate the accounts of repeat infringers.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or availability. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that messages, notifications, or calls will be delivered, or that content stored with the Service will not be lost; keep your own copies of anything important.
AI and transcription accuracy. Transcriptions, translations, summaries, and other AI-generated outputs may be inaccurate, incomplete, biased, offensive, or fabricated (so-called "hallucinations"), and may not reflect the actual content of the source audio or the views of ZCC Labs LLC or its vendors. You are solely responsible for reviewing, verifying, and exercising human oversight over AI-generated outputs. Do not rely on the Service for medical, legal, financial, safety-of-life, or other high-stakes decisions. If you use the Service in a regulated or safety-critical context, you do so at your sole risk.
Other users. We are not responsible for the conduct of other users or for content they send you or share with you.
To the maximum extent permitted by law, ZCC Labs LLC and its officers, directors, employees, and vendors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, revenue, profits, goodwill, or business opportunities, arising from or related to your use of the Service, whether in contract, tort, or any other theory, even if we have been advised of the possibility of such damages.
The aggregate liability of ZCC Labs LLC for all claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the total amounts you paid ZCC Labs LLC in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless ZCC Labs LLC, its officers, directors, employees, agents, and vendors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time from the Settings page. Upon termination, your right to use the Service ceases immediately, and your data is deleted as described in our Privacy Policy (note that copies other users have imported, and records we must keep, are not deleted). Deleting your account does not cancel an App Store subscription; cancel it with Apple. Sections 6 through 12, 14, and 17 through 27 survive termination.
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before filing any formal claim, you agree to attempt to resolve the dispute informally by contacting support@buffermind.com. We will work in good faith to resolve the dispute within thirty (30) days.
Binding individual arbitration. If informal resolution fails, you and ZCC Labs LLC agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this agreement to arbitrate.
Class action waiver. You and ZCC Labs LLC agree that each party may bring claims against the other only in its individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Jury trials are waived to the maximum extent permitted by law. The arbitrator has no authority to arbitrate claims on a class or representative basis.
Exceptions. This arbitration agreement does not apply to: (i) claims in small-claims court where eligible; (ii) claims for injunctive relief to protect intellectual property or confidentiality; or (iii) any claim that cannot be waived under applicable law, including (per U.S. federal law) any claim of sexual assault or sexual harassment.
Thirty-day opt-out. You may opt out of this arbitration agreement by sending written notice to support@buffermind.com within thirty (30) days after first accepting these Terms, stating your name, account email, and an unambiguous statement that you wish to opt out. Opting out will not affect any other part of these Terms.
Venue for excluded claims. For claims excluded from arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in the State of Delaware or the State of California, United States.
The Service may be subject to U.S. export control and economic sanctions laws. You represent and warrant that you are not located in a country that is subject to a U.S. government embargo (including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions), and you are not listed on any U.S. government list of prohibited or restricted parties (including the U.S. Department of the Treasury's list of Specially Designated Nationals). You agree not to access or use the Service in violation of any applicable export control or sanctions law.
If you access the Service via the iOS application obtained from Apple's App Store, the following additional terms apply between you and Apple Inc. ("Apple"):
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date above, and will make reasonable efforts to provide additional notice in the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
These Terms are governed by the laws of the State of Delaware (in which ZCC Labs LLC is organized) and the State of California (in which we primarily operate), without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
These Terms constitute the entire agreement between you and ZCC Labs LLC regarding the Service and supersede any prior agreements. If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign these Terms freely.
